INSURANCE & REINSURANCE
The litigation team has extensive experience of insurance and reinsurance coverage litigation in Bermuda courts and arbitration in Bermuda, Hong Kong, London and the United States. We have acted for a wide range of major players in the international reinsurance market including North American insurance and reinsurance companies, Lloyd's syndicates, London market and European companies, Bermuda reinsurance, captives and captive management companies, brokers and underwriting agents. Members of the litigation team have also accepted international arbitration appointments and acted as expert witnesses on English and Bermuda reinsurance law.
FUNDS DISPUTES
ASW's litigation team has considerable experience of funds litigation and is presently heavily engaged in a number of high profile hedge fund cases, both in Bermuda and in the U.S., UK and Europe. This includes matters arising from the Madoff scandal. Our clients consist of Bermuda-based and international investment managers, fund administrators and hedge funds, feeder funds, funds of funds, as well as certain investors and trustees and our team of specialist and multi-disciplined lawyers (many from leading London and New York firms) act as counsel in Bermuda litigation whilst advising on all aspects of funds litigation (including regulatory, restructuring and insolvency issues), all with the directed aim of meeting the commercial concerns of our clients. We have extensive experience of negotiating, on behalf of our clients, with the Bermuda Monetary Authority and Registrar of Companies and senior members of ASW's funds litigation team have accepted expert witness appointments in funds litigation proceeding in US courts and other foreign jurisdictions.
BANKING & FINANCIAL SERVICES
We have acted for and against Bermudian and foreign banks and trust companies in litigation relating to commercial loans, enforcement of security, investment management and trust administration. We have also acted in international litigation involving Bermuda hedge funds, fund of funds, fund managers and placement agents, investors, mutual funds and foreign exchange trading. We have extensive experience of application for emergency injunctive relief, including Mareva injunctions.
CORPORATE & SECURITIES
We have advised on hostile mergers and acquisitions involving Bermuda companies, We have also acted in several shareholder disputes involving local and international companies.
SHIPPING & ADMIRALTY
We have acted in a variety of shipping disputes including litigation relating to charterparties, disputes with underwriters arising out of unexplained sinkings, subrogation claims against marine surveyors and salvage claims.
TRUSTS & ESTATES
We have acted in several trust disputes on behalf of settlors, beneficiaries and protectors of Bermuda trusts. We have also acted in litigation involving the setting aside of trusts.
