Corporate

We are actively involved in the incorporation of insurance and reinsurance companies in Bermuda and have advised on the business plans of proposed new incorporations. We have advised Bermuda and London market underwriters on insurance and reinsurance policy wording and have drafted insurance and reinsurance policies. We have advised Bermuda insurance and reinsurance companies, captive management companies, brokers and underwriting agents on a variety of regulatory issues and have worked closely with the Bermuda regulator. We have also advised reinsurance companies in run-off on restructuring through solvent schemes of arrangement. We have advised clients in relation to a variety of transactions involving segregated accounts companies, risk swaps, catastrophe bonds and credit derivatives.

Insolvency

The insolvency team has extensive experience advising the liquidators of Bermuda insurance and reinsurance companies and has acted for numerous parties in disputes with Bermuda liquidators. We have also advised the Official Receiver and Registrar of Companies of Bermuda in connection with local and international company insolvencies and we have acted for insurance regulators in the US and Canada and advised the UK Policyholders Protection Board. We have extensive experience of cross-border insolvency issues involving Bermuda insurance and reinsurance companies, mutual funds, holding and investment companies and we have worked closely with lawyers in the US, UK, Hong Kong and Canada on cross-border matters and with insolvency practitioners from all of the "big four" accounting firms. Members of the insolvency team have acted as expert witnesses on Bermuda insolvency law in US bankruptcy courts.

We have advised creditors and shareholders of a number of reinsurance companies in run off. We have been involved in the drafting of schemes of arrangement for Bermuda insurance and reinsurance companies, including the first "solvent scheme" in Bermuda, which was sanctioned in the US pursuant to section 304 of the Bankruptcy Code.

The litigation team has extensive experience of insurance and reinsurance coverage litigation in the Bermuda courts and arbitration in Bermuda, Hong Kong, London and the United States . We have acted for a wide range of major players in the international reinsurance market including North American insurance and reinsurance companies, Lloyd's syndicates, London market and European companies, Bermuda reinsurers, captives and captive management companies, brokers and underwriting agents. Members of the litigation team have also accepted international arbitration appointments and acted as expert witnesses on English and Bermuda reinsurance law.
