LIQUIDATIONS
The insolvency team has extensive experience advising the liquidators of Bermuda insurance and reinsurance companies and has acted for numerous parties in disputes with Bermuda liquidators. We have also advised the Official Receiver and Registrar of Companies of Bermuda in connection with local and international company insolvencies and we have acted for insurance regulators in the US and Canada and advised the UK Policyholders Protection Board. We have extensive experience of cross-border insolvency issues involving Bermuda insurance and reinsurance companies, mutual funds, holding and investment companies and we have worked closely with lawyers in the US, UK, Hong Kong and Canada on cross-border matters and with insolvency practitioners from all of the "big four" accounting firms. Members of the insolvency team have acted as expert witnesses on Bermuda insolvency law in US bankruptcy courts.
REINSURANCE RUN-OFFS & SCHEMES OF ARRANGEMENT
We have advised creditors and shareholders of a number of reinsurance companies in run off. We have been involved in the drafting of schemes of arrangement for Bermuda insurance and reinsurance companies, including the first "solvent scheme" in Bermuda, which was sanctioned in the US pursuant to section 304 of the Bankruptcy Code.
DIRECTOR & OFFICER LIABILITY
The insolvency and litigation teams have acted in high profile litigation against Bermuda directors. We have advised both liquidators and underwriters on various D&O issues under Bermuda law.
CORPORATE FRAUD & ASSET RECOVERY
We have acted for creditors and liquidators in several cases involving corporate fraud, fraudulent conveyance, illegal dividend payments and other illegal transfers of assets. We have also acted in litigation involving the setting aside of trusts.
