Reinsurance, Showing an Interest in Common Account Protections

Synopsis: The interest that this summer’s English Commercial Court interim decision in Equitas Ltd v Allstate Insurance Company [2008] EWHC 1671 (Comm) (17 July 2008) brought, highlights the death of legal guidance on the mechanisms of excess of loss reinsurance protections for common account. Law and market practice seem unclear as what is intended by these policies, particularly in commercially stressed situations.
